How to handle business debt

You find your business in times of financial difficulty or you can see a difficult period coming, what should you do?:

Try and work out your total debt
Work out what you can afford to pay each month (if anything)
Prioritise your company's debts, utilities and critical debts first
Take an in-depth look at your cashflow
Contact customers who owe you money
Contact your creditors as soon as you are experiencing or forecasting payment difficulties
Consider disposing excess stock or assets
You must make an early decision on whether the company should continue to trade
Seek advice, contact us on 07860 384852, contact your accountant, visit a Citizens Advice Bureau or call one of the government advice lines
You should seek advice immediately if your company cannot pay its debts, you can't afford staff wages or the business receives a County Court Summons or Judgement

Your legal responsibilities

As a company director you should be aware that you may be personally liable for any debts which you have personally guaranteed.

You may also end up personally liable if you are trading fraudulently or have been wrongfully trading.

If you are found liable you may be disqualified and could face criminal proceedings.
